Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the websites, web applications, integrations, plugins, chat widget, forms, and booking tools operated by Galactica LLC, doing business as Galactica CyberSecurity (“Galactica,” “we,” “us,” or “our”) at https://getgalactica.com and its subdomains (collectively, the “Sites”).

By accessing or using the Sites, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Sites.

Eligibility and Age Requirement

The Sites are offered to businesses and to adults acting in a business capacity. They are not directed to children and are not marketed to children.

You may not access or use the Sites, submit any information through them, or book any appointment through them if you are 13 years of age or younger. Galactica does not knowingly collect personal information from anyone 13 or younger. If we learn that we have received such information, we will delete it promptly. A parent or legal guardian who believes a child 13 or younger has submitted information to us should contact legal@GetGalactica.com, and we will delete it and confirm the deletion. This commitment is described in full in the Children’s Privacy section of our Privacy Policy.

By using the Sites, you represent that you are at least 18 years old, or that you are between 14 and 17 and are using the Sites with the involvement of a parent, guardian, or employer who accepts these Terms on your behalf.

Informational Purpose and No Professional Advice

Content on the Sites is provided for general information about our services. It is not legal, regulatory, compliance, financial, or insurance advice, and it does not create a consultant-client or attorney-client relationship. Security and compliance obligations vary by organization. Do not act on Site content without engaging Galactica or another qualified advisor for guidance specific to your circumstances.

References to frameworks and regulations such as HIPAA, PCI-DSS, GLBA, CMMC, or FTC requirements describe the areas in which we assist clients. They are not a guarantee that any particular service will make your organization compliant.

Relationship to Service Agreements

These Terms cover use of the Sites only. Delivery of managed IT, cybersecurity, and AI services is governed by the separate written agreement between Galactica and the client, such as the Master Service Agreement, Hardware as a Service Agreement, AI Services Agreement, or Cybersecurity Risk Assessment Agreement. Where these Terms conflict with a signed service agreement, the signed agreement controls for the services it covers.

Acceptable Use

You agree not to:

• Use the Sites for any unlawful purpose or in violation of any federal, state, or local law
• Attempt to gain unauthorized access to the Sites, our systems, or any connected network or account
• Probe, scan, or test the vulnerability of the Sites, or breach or circumvent any security or authentication measure, without our prior written authorization
• Interfere with or disrupt the Sites, including through denial of service activity, malware, or automated request volume that degrades availability
• Scrape, harvest, or collect information about other users, including email addresses or phone numbers, for solicitation
• Submit false, misleading, or third-party contact information through any form, or impersonate any person or organization
• Reverse engineer, decompile, or create derivative works from any part of the Sites except as permitted by law
• Use the Sites to transmit unsolicited commercial messages

Unauthorized access to a protected computer may violate the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and comparable state law. We report suspected criminal activity to law enforcement.

Automated Access and AI Agents

Automated clients, crawlers, and AI agents may access the Sites subject to our robots.txt file and to reasonable request rates. We publish a machine-readable summary of the Sites at llms.txt to support that use. Automated access must not be used to circumvent the acceptable use restrictions above.

Forms, Booking, and Communications Consent

Contact forms, chat, and appointment booking on the Sites are delivered through third-party platforms. Information you submit is handled as described in our Privacy Policy.

When you provide a phone number and consent to be contacted, you consent to receive calls and text messages from Galactica at that number, including messages sent with an automatic telephone dialing system where you have given prior express written consent under the Telephone Consumer Protection Act. Consent to receive marketing messages is not a condition of purchasing any service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of text messages, or HELP for help.

When you provide an email address, you consent to receive email replies and, where you have opted in, marketing email. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests as described in our Privacy Policy.

Intellectual Property

The Sites and their contents, including text, graphics, logos, images, layout, and software, are owned by Galactica or its licensors and are protected by United States copyright and trademark law. “Galactica CyberSecurity” and the Galactica logo are marks of Galactica LLC. You may view and print pages for your internal business evaluation. Any other reproduction, distribution, public display, or commercial use requires our prior written permission.

Third-party names and marks appearing on the Sites belong to their respective owners and are used for identification only.

Copyright Complaints

If you believe material on the Sites infringes your copyright, send a written notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) that includes your signature, identification of the copyrighted work, identification of the material and its location, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that the notice is accurate and that you are authorized to act for the owner. Third-Party Links and Services

The Sites link to and embed third-party services, including scheduling, chat, forms, analytics, and social platforms. We do not control those services and are not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms.

Accessibility

We build and test the Sites against the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and work to keep them usable with screen readers, keyboard navigation, and assistive technology. Accessibility is treated as an ongoing obligation rather than a one-time project. If you encounter a barrier on any page, contact legal@GetGalactica.com or call 406.534.0911. Disclaimer of Warranties

The Sites are provided “as is” and “as available.” To the fullest extent permitted by law, Galactica disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Sites will be uninterrupted, timely, secure, or error free, or that content is accurate or current. Nothing in this section limits any warranty expressly given in a signed service agreement.

Limitation of Liability

To the fullest extent permitted by law, Galactica and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of or inability to use the Sites, even if advised of the possibility. Our total liability for any claim arising from the Sites will not exceed one hundred dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold Galactica harmless from any claim, loss, liability, or expense, including reasonable attorneys’ fees, arising from your use of the Sites, your violation of these Terms, or your violation of any law or third-party right.

Governing Law and Disputes

These Terms are governed by the laws of the State of Montana, without regard to its conflict of laws rules. You and Galactica agree to the exclusive jurisdiction and venue of the state and federal courts located in Yellowstone County, Montana, for any dispute arising from the Sites, and each party waives any objection to that venue.

Export and Sanctions Compliance

You may not use the Sites or receive our services if you are located in, ordinarily resident in, or organized under the laws of a country or region subject to comprehensive United States sanctions, or if you appear on any restricted-party list maintained by the U.S. Department of the Treasury or Department of Commerce.

Changes to These Terms

We may modify these Terms at any time. Changes take effect 14 days after they are posted at https://getgalactica.com/terms-of-use. Continued use of the Sites after that date means you accept the revised Terms. The “Last Modified” date above reflects the current version.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and any signed service agreement, are the entire agreement between you and Galactica regarding the Sites.
